Rental Rules by City / Free checklist / Miami Beach
Is my Miami Beach rental legal? Checklist
📋 The Basics
- Can I rent my place short-term here?
- Only in some areas
- Do I need a permit?
- Yes. You need a city Business Tax Receipt, a Resort Tax account and a Certificate of Use.
- What taxes do I pay?
- Total about 14%. Airbnb collects some; you pay the 4% Miami Beach Resort Tax yourself.
Your 3 steps to be legal
- Check your zoning: short-term rentals are banned in all single-family homes and many apartment buildings.
- Get the city Business Tax Receipt, Resort Tax account and Certificate of Use.
- Show your receipt and Resort Tax numbers in every listing.
⚠️ Biggest risk: Renting in a single-family home, which is banned here.

Total rate: 14%. Verified: the 7% is 3% Miami-Dade Convention Development Tax + 4% City of Miami Beach Resort Tax (Miami Beach is exempt from the county's 2% Tourist Development and 1% Sports taxes). The 4% resort tax is not on Airbnb's collection list, so file it with the city. Calculate.
